1. These Terms set out the rules for providing electronic services through the iziphoto.pl website, operated by Stanislav Ievlentiev, a sole trader at Jana Henryka Dąbrowskiego 89/41, 60-574 Poznań, Poland, NIP: 7812093544 (the “Service Provider”).

3. iziphoto.pl provides a digital service for preparing photos for documents through the website iziphoto.pl.
4. Using the Service means accepting these Terms.
5. The Terms are available free of charge at iziphoto.pl/regulamin.
1. User — a natural person using the Service.
2. Service — the paid preparation of a digital document photo based on a photo uploaded by the User.
3. Order — an instruction to perform the Service together with payment.
4. Final file — the finished photo prepared for the User to download.
1. The Service Provider offers:
2. The detailed scope and prices of the services are shown on the website.
3. The online Service is digital and is performed automatically.
4. The Service Provider also offers taking a photo on site at the User’s location (the “On-site Service”) in Poznań and within 50 km of Poznań, for one person or a group of people. The photo is taken by the Service Provider, and the finished digital file is handed over to the User.
5. The price of the On-site Service (PLN 89 — Poznań, PLN 119 — up to 50 km from Poznań) covers the visit and is the same for one person and for a group. The photo itself is charged according to the price list referred to in item 2.
6. The date and place of the visit are agreed with the User (WhatsApp, phone or e-mail). § 6 items 4–5 and §§ 7–9 apply accordingly to the On-site Service.

3. An order is considered placed when the payment operator confirms the payment.
1. Payments are processed by Przelewy24 (DialCom24 Sp. z o.o.).
2. The available payment methods correspond to the payment operator’s current offer.
3. If no payment is made, the Service is not performed.
4. The e-mail address may be passed on by the payment operator solely to perform the Service.
1. The Service is performed automatically after the payment is confirmed.
2. The Service is performed without delay, within 5 minutes at the latest.
3. The Service is considered performed when the file is made available for download.
4. Files are available for 24 hours and are then permanently deleted. Files prepared in the partner cabinet (agencies) are available for 14 days and are then permanently deleted.
5. The Service Provider makes every effort to ensure the photos meet the technical requirements for documents; however, the final decision rests with the competent authority.
1. Subject to § 9, the Service Provider does not guarantee that the photo will be accepted by the authorities issuing documents. If the MOS system rejects the photo, the User has the rights described in § 9.
2. The User is responsible for the quality of the uploaded photo and its compliance with the basic requirements.
3. Subject to § 9, the Service Provider is not liable for a photo being rejected because of unsuitable source material uploaded by the User.
4. The Service Provider is not liable for technical interruptions beyond its control.
1. Complaints should be sent to: kontakt@iziphoto.pl
2. A complaint should describe the problem and include the details needed to identify the order.
3. Complaints are handled within 14 calendar days.
4. If a complaint is upheld, the Service may be performed again or the payment refunded.
1. If the MOS system rejects a photo prepared as part of the Service, the User may, at their choice, request:
2. To use the guarantee, the User must send to kontakt@iziphoto.pl a screenshot from the MOS system showing that the photo was rejected, together with the order access code.
3. The request can be submitted within 14 days from the day the file was made available for download.
4. The Service Provider handles the request without delay, and no later than 14 days after receiving the complete request.
5. The refund is made using the same payment method that was used for the payment.
6. A free re-preparation requires a new source photo, because files are deleted after 24 hours (§ 6 item 4).
7. The guarantee does not apply where the file was modified by the User after download.
8. The guarantee does not exclude or limit the User’s rights under the law, including rights arising from the Service not conforming to the contract.
1. The User consents to the Service being started before the 14 days from conclusion of the contract have passed.
2. Once the Service has been performed, the User loses the right to withdraw from the contract.
3. A contract for the On-site Service may be concluded away from the business premises. A Consumer has the right to withdraw from it within 14 days of concluding the contract. If, at the Consumer’s express request, performance of the Service has begun before that period expires, the Consumer shall pay for the service provided up to the moment of withdrawal, and once the Service has been fully performed, after prior confirmation that the right is lost, the right of withdrawal expires.

1. These Terms are governed by Polish law.
2. A consumer may use the ODR platform.
3. The current version of the Terms is available at iziphoto.pl/regulamin.
4. The Terms may be made available in language versions (Ukrainian, Russian and English) solely for the User’s convenience. In the event of any discrepancy, the Polish version prevails.
